Noise from a car stereo parked in a public place
Q: What can be done about a loud stereo playing from a parked car in a public place? Can an abatement notice be used in this situation? I know it's excluded for a moving vehicle - but what about parked?
Answers:
We issue a verbal END ( Excessive Noise Direction ) for such vehicles on private properties or in public places. If they don't comply the police can assist to remove or render the noise making equipment unoperable (Remove Car Battery or parts of the system) Under Section 327 RM Act I refers to " any place " the noise is being admitted from. Under Section 328 (b) you can lock, seal or make unusable any."............Vehicle....." that is producing or contributing to any excessive noise!
